MEMPHIS, Tenn. (AP) -- A case that spotlighted problems at the Memphis Sexual Assault Resource Center has been sent to a Shelby County grand jury.

Defense attorney Leslie Ballin said charges against his client Kevin J. Morgan could be a problem for the state because the girl who claimed she was assaulted was sent home from the center without being examined.

Morgan is accused of raping a 14-year-old girl who was staying overnight with his daughter in their Bartlett home.

The Commercial Appeal reported a Bartlett detective and the girl waited for hours on April 25 at the center, only to be told no nurse was available and to return the next day.

Prosecutor David Lakin declined to answer questions on Monday about the evidence and the rape crisis center situation.
