Little Rock, AR - Friday morning, October 23, 2009, a judge denied a request by Curtis Vance's lawyers to delay Vance's November 2nd trial. The defense argued Vance may be mentally disabled and that he needs more tests. Vance's attorneys say the state should not seek the death penalty because of their client's mental state.
Earlier tests show Vance has an IQ of 75. Arkansas law only prohibits the execution of anyone with an IQ score of 65 or below.
Vance is accused of attacking Little Rock TV news anchor Anne Pressly in her home last year. She died in the hospital several days later.
