MEMPHIS, TN -- Police say a man is behind bars after he broke into a Memphis home and then fell asleep.

It happened in the Longview Heights area around 1:00 a.m., Tuesday, February 3, 2009.

According to investigators, a neighbor saw the man breaking in through a window and called police.

When they arrived at the house they say they found the man asleep inside.

Nobody was home at the time of the break-in. That’s because, police say the homeowner is an elderly person and is in the hospital. The utilities to the house had been turned off for the duration of the homeowner’s hospital stay.

The middle-aged man who was found asleep inside the house told police that he is homeless and had been living in the home for the past 4 or 5 days.

The man has been charged with aggravated criminal trespassing which is a misdemeanor.
Police do not think that the man took anything from the house.
