Tennessee Deputy Killed, Double Jeopardy Argument Against Trial

KNOXVILLE, Tenn. (AP) -- An attorney for Rocky Joe Houston will argue his former client shouldn't be tried again in the killing of a Roane County deputy and another man.

The Knoxville News-Sentinel reported Houston's former lawyer will be before the Tennessee Court of Criminal Appeals on Tuesday in Knoxville, trying to convince the court that retrying Houston would be double jeopardy.

At Houston's first trial, the jury found him not guilty on eight charges in the 2006 killings of Deputy Bill Jones and ride-along friend Mike Brown. But jurors left the rest of the form blank, not indicating a decision in Jones' death or a voluntary manslaughter charge in Brown's killing.

Houston's brother, Leon Houston, was retried after a mistrial and a jury acquitted him off all charges last week.
